Vigzar MedCare — Terms & Conditions

Please read these Terms and Conditions carefully before using the Vigzar MedCare application. By downloading, installing, or using the App, you agree to be bound by these terms.

1. Acceptance of Terms

By accessing or using Vigzar MedCare ("App"), operated by Vigzar Technologies ("Company", "we", "us", "our"), you agree to these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms apply to all users of the App, including individual users, caregivers, and family account managers.

2. Description of Service

Vigzar MedCare is a personal health management application that provides:

Medication reminder and tracking functionality

Family health profile management

Health records storage and organisation

Medication adherence analytics

Doctor directory and appointment tracking

Encrypted local health data storage with optional cloud backup

The App is a personal health management tool and is not a medical device, clinical service, or substitute for professional healthcare.

3. Medical Disclaimer

IMPORTANT — PLEASE READ CAREFULLY

Vigzar MedCare is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or health condition.

The App provides organisational and reminder tools only

The App does not provide medical advice

The App does not replace consultation with qualified healthcare professionals

Always consult a licensed physician, pharmacist, or healthcare provider regarding your medications, health conditions, and treatment plans

Never disregard professional medical advice or delay seeking it because of information in or features of this App

In a medical emergency, contact emergency services immediately — do not rely on this App

We make no representations or warranties that the App will prevent medication errors, missed doses, or adverse health outcomes. You use the App at your own risk for health-related purposes.

4. Eligibility

To use Vigzar MedCare, you must:

Be at least 18 years of age, or have parental/guardian consent if under 18

Have the legal capacity to enter into this agreement

Use the App only for lawful purposes and in accordance with these Terms

If you are using the App on behalf of another person (such as an elderly parent or a child), you represent that you have the authority and consent to manage their health information through the App.

5. User Account & Authentication

5.1 Google Sign-In

The App uses Google Firebase Authentication. By signing in, you agree to Google's Terms of Service in addition to these Terms.

5.2 Account Security

You are responsible for:

Maintaining the security of your device and Google account

All activities that occur under your account

Notifying us immediately of any unauthorised access

5.3 Account Termination

You may delete your account at any time from within the App. We reserve the right to suspend or terminate accounts that violate these Terms.

6. Data Ownership & Responsibility

6.1 Your Data

All health data you enter into the App belongs to you. We do not claim ownership of your health information. See our Privacy Policy for full details on data handling.

6.2 Data Accuracy

You are solely responsible for:

The accuracy of information you enter (medication names, dosages, schedules)

Ensuring entered information matches your actual prescriptions and treatment plans

Verifying reminder times and medication instructions with your healthcare provider

We are not liable for any health consequences resulting from incorrect data entry.

6.3 Data Loss

While we implement AES encryption and Google Drive backup, we cannot guarantee against data loss. You should:

Regularly enable and verify backups

Maintain independent records of your medications and health information

Not rely solely on this App as your only medication record

7. Acceptable Use

You agree not to use the App to:

Violate any applicable laws or regulations

Impersonate any person or entity

Transmit harmful, offensive, or unlawful content

Attempt to gain unauthorised access to App systems or other users' data

Use the App for any commercial purpose without our written consent

Reverse-engineer, decompile, or disassemble the App

Remove or alter any proprietary notices or labels

8. Intellectual Property

8.1 Our Property

The App, including its design, code, content, trademarks, and brand elements, is the exclusive property of Vigzar Technologies and is protected by applicable intellectual property laws.

8.2 Your Licence

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App on your personal device(s) for personal, non-commercial purposes, subject to these Terms.

8.3 Your Content

You retain all rights to the health data and content you create within the App. By using backup features, you grant us the technical permissions necessary to facilitate that backup — nothing more.

9. Payments & Subscriptions

9.1 Free Tier

Core features of Vigzar MedCare are available free of charge.

9.2 Premium Features

Certain premium features may require a paid subscription. Payments are processed through:

Razorpay for Indian users

Google Play Billing for in-app purchases

All purchases are subject to the payment processor's terms. Subscription fees are clearly displayed before purchase.

9.3 Refunds

Refund requests are handled in accordance with Google Play Store policies and applicable consumer protection laws. Contact support@vigzar.com for refund inquiries.

10. Disclaimers & Limitation of Liability

10.1 As-Is Basis

The App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to:

Warranties of merchantability or fitness for a particular purpose

Warranties that the App will be uninterrupted, error-free, or secure

Warranties regarding the accuracy of reminder delivery

10.2 Limitation of Liability

To the maximum extent permitted by applicable law, Vigzar Technologies shall not be liable for:

Any indirect, incidental, consequential, or punitive damages

Loss of data, revenue, or profits

Health outcomes resulting from App use or malfunction

Missed medication reminders due to device settings, Do Not Disturb mode, or network issues

Any damages exceeding the amount you paid for the App in the preceding 12 months

11. Third-Party Services

The App integrates with third-party services including:

Google Firebase — Authentication and crash analytics

Google Drive — Optional encrypted backup

Razorpay — Payment processing

Your use of these services is governed by their respective terms and privacy policies. We are not responsible for third-party service outages or policy changes.

12. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India.

If you have a concern, complaint, or dispute regarding the App, we encourage you to contact us first at support@vigzar.com so that we can attempt to resolve the matter informally and in good faith.

Any legal disputes arising out of or relating to these Terms or the use of the App shall be subject to the exclusive jurisdiction of the courts located in Thiruvananthapuram, Kerala, India.

13. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes:

We will notify you within the App

Continued use constitutes acceptance of revised Terms
